Temporary resident visa (TRV) in the Philippines: residence by marriage when reciprocity is missing
Not every foreign spouse of a Filipino citizen can take the immigrant visa by marriage: it depends on whether their own country grants Filipinos the same privilege. Where it does not, the Bureau of Immigration offers the temporary resident visa, extended rather than made permanent. Asia Relocation Philippines files it, plans around the passport the Bureau keeps, and dates every extension.
Marriage to a Filipino citizen gives a foreign national a residence route in the Philippines, but the route has two doors. Where the spouse's country grants Filipinos the same privilege, the immigrant visa by marriage applies. Where it does not, the Bureau of Immigration offers a temporary resident visa on the same basis, under a separate instruction, extended rather than converted to permanent residence.
The file looks like the immigrant one and behaves differently in two ways that surprise households. The passport is surrendered to the Bureau for the whole pendency of the application and returned by courier with the decision, and any request to pull it out before then is treated as abandoning the file. And the visa never stops needing an extension: each one is a filing with a hearing, for as long as the marriage and the residence last.
Asia Relocation Philippines has run these files since 2011, from Manila and for couples in Cebu and Clark. The consultant who checks reciprocity assembles the file, plans travel around the surrendered passport, and keeps the calendar of extensions.
What the resident visa file carries, and what its sister route carries
The immigrant visa by marriage is the page most couples arrive from; the differences are on the right.
Carried by the service
- The reciprocity check: your nationality read against the routes, so the file that opens is the right one, and the separate regime for Indian nationals read where it applies.
- The documents: passport, the marriage certificate apostilled or authenticated where the marriage was abroad, your spouse's birth certificate from the statistics authority, the police and quarantine clearances where the timing or the case requires them.
- The passport plan: travel and identification arranged for the months the Bureau holds your passport, and the courier pouch, receipt and address handled so the decision comes back to you.
- The hearing and the card: prepared and attended with you, biometrics captured, the visa implemented in the passport and the registration card delivered with it.
- Every extension: filed before the current visa ends, with the hearing and, when due, the biometric recapture, dated in our calendar from the last stamp.
The months without a passport are written into the plan before the file is lodged, not discovered when a flight is booked.
A different page
- A nationality with reciprocity. The same marriage then opens the 13A immigrant visa, probationary then permanent, at authorised offices outside the capital too.
- A spouse who is a former Filipino. If your husband or wife lost Philippine citizenship abroad, re-acquiring it may change your route; we check that first.
- Everything after the card. The annual report, the card's renewal and the exit clearance before a trip: our other immigration services.
- The home you will live in. Finding it and negotiating the Letter of Intent is home search in Manila, on the same file if you wish.
One coordinator, whichever door the nationality opens.
Four files on the same visa
Conversion, extension, the Indian regime, and the change of route.
Conversion from a visitor stay
The first filing: the stay kept valid, the documents apostilled, the passport surrendered, the hearing attended, the visa and card returned by courier. The months without a passport are planned before the file is lodged.
Extension
Filed before the current visa ends, with a hearing; the earlier biometrics reused and recaptured every five years for applicants aged eleven and over. The passport is surrendered again for the pendency.
Indian national married to a Filipino
A separate conversion and a separate extension published by the Bureau, with their own periods and fees. The same documents, a different calendar, and we read the right one.
Change of route
A spouse who re-acquires Philippine citizenship, or a nationality that gains reciprocity, can move the couple to the immigrant visa. We watch for it, because the other door is the better one when it opens.
Reciprocity, documents, passport surrendered, hearing, courier back
-
The route
Your nationality read against reciprocity and against the Indian regime, your current stay checked, your spouse's status confirmed. If the immigrant visa applies instead, we say so now.
-
The documents, and the passport plan
Marriage certificate apostilled where needed, the spouse's birth certificate from the statistics authority, the clearances the timing calls for. Then the calendar: no travel while the Bureau holds the passport.
-
Filing at the main office in Manila
Application, passport and documents lodged, fees and courier paid, the pouch labelled with your address. The passport goes to the Bureau; the file goes to a hearing officer.
-
The hearing and the biometrics
Prepared and attended with you; image and fingerprints captured for the registration card. On an extension the earlier capture is reused unless it is due again.
-
The courier, then the next date
The approval order, the passport with the visa implemented and the card are delivered to you. The next extension goes into our calendar the same day.
The couples this door is built for
Spouses from countries without reciprocity
The nationality decides, and this is the route the Bureau provides for them. The marriage is the same; the visa is extended rather than made permanent.
Indian nationals married to a Filipino
A regime of their own at the Bureau, with its own conversion and extension. Read separately, filed on the same shape of file.
Holders whose extension is due
The visa needs extending for as long as the residence lasts, and each extension is a filing with a hearing. We keep the calendar so the stay never lapses.
Couples who travel
The surrendered passport is the constraint households underestimate. We plan the filing around the trips, or the trips around the filing.
Filed at the main office in Manila only, for couples anywhere in the country
Unlike its sister route, this visa is a Bureau of Immigration filing at the main office in Manila; the couples we serve live in Metro Manila, Cebu and Clark.
The Bureau publishes this transaction for its main office alone, so a couple in Cebu or Clark files in the capital and attends the hearing there. We schedule the trip with the filing, and the courier returns the passport and the card to the home address, wherever it is.
The documents from abroad, the marriage certificate above all, are the slow part and are slower from here. We start them before the flight.
What couples ask when the immigrant visa is out of reach
Who needs the temporary resident visa rather than the immigrant visa by marriage?
Why does the Bureau keep my passport?
Is it permanent?
What documents does the file need?
Can I work on it?
Is there a different regime for Indian nationals?
What happens at the hearing and the biometrics?
What if the marriage ends?
The other door, and the silo above
Your country does have reciprocity
